Terms and Conditions for Online Shopping

If you continue to browse and use this Website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Farima Perry and Florals and Events Ltd’s relationship with you in relation to this Website. If you disagree with any part of these terms and conditions, please do not use our Website.

The term ‘Farima Perry’ or ‘us’ or ‘we’ refers to the owner of the Website whose registered office is 155 Haverstock Hill, London NW3 4QT. Our company registration number is 09805291. The term ‘you’ refers to the user or viewer of our Website.

1. Our Products

1.1 Products are subject to availability. If we are unable to supply your chosen item we reserve the right to substitute a product of equivalent value, quality and colour.
1.2 All products are subject to availability. If we are unable to provide your chosen item or a suitable substitution we will advise you as soon as possible and refund your payment in full within 30 days of the intended delivery date.
1.3 We may deliver some flowers in bud to increase vase life.

2. Prices

2.1 Prices listed on our Website are valid for a maximum of 14 days after placing your order.
2.2 Prices include VAT and exclude delivery charges.

3. Orders / Payment

3.1 In order to fulfil your order we require all necessary fields contained within the order form to be completed with the relevant information. By submitting your order and payment details, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions and appearing anywhere on the Website.
3.2. Payment Security: We recommend you order online using our secure order form. We accept payment by most major credit and debit cards. If using a credit card from outside the Euro zone the currency conversion will be calculated by the credit card company.

4. Delivery

4.1 We deliver within the London area.
4.2 Delivery charges will be applicable within the specified area. If you request delivery to remote areas which are not normally delivered to you will be advised of any additional charges as soon as possible upon receipt of your order.
4.3 Should a timed delivery be requested we will endeavour to comply with your request but cannot be bound in any way to honour such a request.
4.4 For next day delivery we must receive your order by 18:00 (6pm) on the day before. We deliver every day with the exception of public holidays. We will process orders received on Saturdays or Sundays, on the next working day.
4.5 Where incorrect personal and delivery details have been supplied problems or delays in delivery may result, therefore please ensure that you have included the full address details, of the intended recipient and your daytime telephone number or e-mail address so that we can notify you in the event that any delivery problems occur.
4.6 Whilst we will use all reasonable endeavours to ensure that delivery is made on the requested date, you acknowledge that in very rare circumstances delivery on the requested terms will not be possible. In this event you will be given prior notice wherever possible and we shall either make alternative arrangements or shall refund your payment in full (as per 1.2).
4.7 Where a third party is involved during delivery, such as businesses and hospitals, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery to your chosen recipient.
4.8 In the instance of there being difficulties in delivering your order to the intended recipient we reserve the right to contact the recipient using the contact details you provide in your order. Should the recipient not be home we will attempt to deliver to a neighbour or post a card through the letterbox informing them that a delivery has been attempted.

5. Cancellation

5.1 Orders may be amended or cancelled up to 24 hours before the intended delivery date.

6.2 Please note that due to the perishable nature of our products, and in order to assist us in resolving your complaint swiftly, we advise that you make any complaint within 24 hours of the date of delivery.

7. General

7.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Website from time to time. We will post any changes on the Website and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Website. Changes will be effective five hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.
7.2 Additionally, we reserve the right to suspend, restrict or terminate access to the Website for any reason at any time.
7.3 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Website, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
7.4 We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions and as stated in our Privacy Policy.
7.5 A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act.
7.6 Save in respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.
7.7 Your purchase will be deemed to have occurred in England and Wales. These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.
